Bikram Yoga College of India-Zurich GmbH

1.0 Scope of application

1.1

These General Terms and Conditions (GTC) govern the legal relationship between Bikram Yoga College of India-Zürich GmbH, Grüngasse 21, 8004 Zurich, and its members.

1.2

Additional contractual provisions apply to certain services and products offered by Bikram Yoga Zurich. The member acknowledges that changes to the GTC and other usage regulations (such as operational policies and privacy statements), which form an integral part of the GTC, may be made for valid reasons. These changes will be communicated to the member in an appropriate manner. If the member rejects these changes in writing within 30 calendar days, the previous GTC will continue to apply until the end of the contract period. No rights can be derived from changes to the GTC. The current contractual terms are always available on www.bikramyoga.ch.

2.0 Membership and services

Bikram Yoga offers various yoga and subscription packages, which are subject to the current terms and conditions. All yoga and subscription offers correspond to the currently valid rates and times. The subscription is personal and cannot be transferred. Bikram Yoga Zurich reserves the right to carry out checks in this regard. Any violation will result in a ban from the premises for the subscription holder and the unauthorised third party. In this case, there is no entitlement to a refund of the amount paid.

Membership contracts concluded online are considered legally binding once Bikram Yoga Zurich has received payment.

3.0 Data protection

The subscription holder acknowledges that a customer profile will be created on the first visit in order to manage their classes/subscriptions electronically. The member is obliged to notify Bikram Yoga Zurich of any changes to contract-relevant information (e.g., name, address) within 14 days. This data is available to him/her for reimbursement of health insurance contributions or receipts. If the address is incorrect, health insurance companies may refuse to pay the health insurance contribution.

The processing of personal data in connection with membership contracts is subject to the privacy policy. By entering into the contract, the member accepts the processing of their personal data as outlined in the privacy policy.

4.0 GTC

The member agrees to adhere to the GTC and follow the instructions of the staff. These GTC are considered an integral part of the membership.

5.0 Operating rules

All visitors are obliged to follow the instructions of the Bikram Yoga Zurich staff and to observe the current yoga etiquette. Gross violations of non-compliance and repeated violations of the applicable guidelines will result in a ban from the premises. In this case, there is no entitlement to a refund.

5.1

Members and third parties are prohibited from offering goods or services, either for free or for a fee, within the premises of Bikram Yoga Zurich without express written permission from Bikram Yoga Zurich.

6.0 Hygiene

6.1

The member agrees to comply with the current hygiene regulations of the Federal Office of Public Health (FOPH) and the instructions of the operating staff. Members with symptoms of illness, suspected infection with transmissible pathogens, or under (official or self-imposed) quarantine are not allowed to enter the facilities. Even with compliance with hygiene regulations, the risk of infection cannot be completely excluded. Bikram Yoga Zurich disclaims any liability in this regard.

6.2

At Bikram Yoga Zurich you should not only feel comfortable, but also be able to rely on cleanliness and hygiene. This is guaranteed by thorough and daily cleaning. Accordingly, our course participants oblige not to enter the classrooms with shoes on, to take them off at the entrance and to place them on the shelf provided for this purpose. All course participants must use a yoga mat. The use of a large bath towel as a sweat mat is obligatory. Course participants who do not fulfil these requirements will be excluded from participating in the course.

7.0 Opening hours and closure

7.1

The operating hours of Bikram Yoga Zurich and the course programme are subject to change at any time.

7.2

Except for the 6:30 class (20 minutes before), the studio opens 30 minutes before the respective class and closes 30 minutes after the respective yoga class. 

7.3

In the event of an operational closure (due to maintenance, technical issues, or special events), there is no entitlement to a refund for prepaid fees or an extension of the contract duration.

7.4

In the event of an operational closure due to force majeure (such as fire, epidemics, pandemics, government restrictions, or strikes) and/or actions by government authorities, there is no entitlement to a refund for prepaid fees or an extension of the contract duration.

7.5

Bikram Yoga is generally open daily with the exception of individual public holidays. The exact opening hours can be found in the applicable timetables. If Bikram Yoga Zurich does not conduct one or more lessons (Extreme weather, lack of yoga teachers, etc.), Bikram Yoga Zurich cannot be held liable for any damages. There is no entitlement to fulfilment of the offer. Bikram Yoga reserves the right to change the opening hours. Lessons are organised for a minimum of 3 participants. 

8.0 Contract interruption and rest periods

8.1

Failure to use a Bikram Yoga Zurich membership does not entitle the member to a reduction, refund, or extension of the membership fee.

8.2

Members with a contract duration of at least 12 months are eligible for a contract suspension under the conditions outlined below.

8.3

In the case of valid reasons (e.g., chronic illness, pregnancy, accident, military service, business travel, or study abroad), the membership can be suspended for a minimum of 1 month and a maximum of 9 months. However, there is no entitlement to a suspension.

8.4
A retroactive suspension is only possible in the case of illness or accident. This must be requested within one month after the end of the medically certified inability to train. Requests submitted later will not be considered.

8.5

For vacations of at least 1 month and up to 4 months, a one-time suspension is possible within the contract duration upon presentation of travel documents.

8.6

The AutoPay can be paused for holiday and rest periods under the same conditions with a processing fee of 50.

8.7

The processing fee for a vacation break is CHF 50 and must be submitted in writing to the management and paid before the absence.

8.8

If abusive suspension is detected or suspected, Bikram Yoga Zurich reserves the right to terminate the membership contract immediately and without refund.

8.9

If the member enters the facility during a contract suspension, the suspension will be immediately and irrevocably terminated. Retroactive suspensions can only be considered for periods during which no entry into the premises of Bikram Yoga Zurich has taken place.

9.0 Cancellation, refund:

9.1

Unlimited time subscriptions

All memberships with a one-off payment expire automatically after the term without notice. The member will receive an e-mail reminder to renew the membership before the end of the contract period.

9.2

Memberships with a duration of less than 12 months will automatically expire at the end of the contract period without cancellation. Withdrawal from the membership is expressly excluded.

9.3

Year membership (12 months)
A withdrawal from the contract is only possible in exceptional cases, such as chronic illness, accident, or permanent relocation outside the Bikram Yoga Zurich training area (more than 100 kilometers away), and is subject to approval. The membership contract must be submitted along with a written request and necessary confirmations (e.g., medical certificate**, employer's confirmation, proof of residence) to Bikram Yoga Zurich.

Up to the 6th month, the member is entitled to a partial refund or waiver of the membership fee. After the 6th month, the membership is considered non-refundable.

• In the 1st month:  50% refund of the contract price*
• In the 2nd month: 40% refund*
• In the 3rd month: 30% refund*
• In the 4th month: 25% refund*
• In the 5th month: 15% refund*
• In the 6th month: 10% refund*
•  From the 7th month: no refund

* The refund/waiver is based on the total contract price, less CHF 50.00 for administrative costs.

** A temporary sports dispensation is not sufficient for a refund.

Bikram Yoga Zurich requires a full medical certificate that provides the required proof of the chronic nature of the diagnosed illness and gives details of the date of diagnosis.

9.4

AutoPay

Our AutoPay with monthly premium payment has a minimum term of 12 months and can be cancelled monthly thereafter.

9.5

Block cards

Contract cancellations for single entries or 10-entry membership are excluded, but can be passed on to a third party for a processing fee of CHF 50.

10.0 Payment and late payment

10.1

The membership fee is determined according to the current price list (available at www.bikramyoga.ch). Without payment, there is no access authorization. The fee is due regardless of the actual use of the service.

10.2

The membership fee for memberships with a one-time payment must be paid in full before the contract period begins.

10.3

AutoPay instalments: 

If monthly membership instalments are not paid, Bikram Yoga Zurich may refuse access.

10.4

For memberships with a duration of less than 12 months, the membership fee is also due before the contract period begins.

10.5

Block cards: are personal and non-transferable. 

10.6
Students (under 26), apprentices, pensioners (AHV), IV, unemployed, single parents, KulturLegi and refugees receive a 25% discount on admission and memberships. This discount can only be granted on site at the studio on presentation of a valid ID and cannot be combined with other discounts.
(except: Intro, Auto Pay, private lesson).

11.0 Liability, safety, risks:

The use of the facilities of Bikram Yoga Zurich is at your own risk. A sports medical examination before purchasing a subscription is recommended for people who have not exercised for a long time, have health problems or have suffered from a serious illness in recent years. Bikram Yoga Zurich and its staff are not liable for any damage caused by injuries sustained by course participants. Bikram Yoga Zurich accepts no liability for theft, damage or items left behind or deposited. Insurance in this regard is the responsibility of the course participant. This also applies to the lockable safe deposit boxes provided free of charge by Bikram Yoga Zurich.

12.0 Changes:

Changes to the terms and conditions, the offers, the conditions and the yoga etiquette are reserved and will be brought to the attention of the course participant and subscription holder in an appropriate form. They do not entitle the holder to a refund.

13.0 Applicable law:

Swiss law applies to all disputes arising from and/or in connection with a contract between Bikram Yoga Zurich and a customer, to the exclusion of Swiss international private law (IPRG).

14.0 Place of jurisdiction is Zurich

The exclusive place of jurisdiction for disputes arising from and/or in connection with this contract is Zurich.
